Wills
- No matter how young you are or few assets you have, you should prepare a will.
- Do not forget that your children are your most precious asset; therefore, if you have minor children you definitely need a will so that you may designate your preference of who should be the guardian of your children in the event that something fatal happens to you.
- Know the requirements that need to be met to make your will valid and complete so that there are no will contests and/or disputes.
- Keep any wills and/or codicils that you prepare in a safe place with at least one other person with either a copy or knowledge of where the will is being kept.
Probate
- Once your loved one has passed, do a thorough investigation and/or search for any wills and/or codicils that may have been executed by the decedent.
- Contact an attorney immediately to discuss your rights and options for the type of administration of the estate that is suitable for your family’s situation.
- Begin to determine what, if any, liabilities the decedent had because researching this early will help to expedite the probate process when it comes time to notify the decedent’s creditors of their time periods within which to get their claims filed.
- Know that neither you nor any other potential heirs and/or beneficiaries will have access to or be able to convert the decedent’s assets legally once the decedent has passed and the probate process has began.
